At Gowan Home, the leading distributor of SharkNinja in Ireland, we exist to deliver on our mission of “positively impacting people’s lives, every day in every home.” This includes doing everything reasonably possible to protect your privacy and secure your personal information.

This Privacy Notice aims to inform you about how we collect, use, disclose, and store personal information when you:

  • Access or use any of our websites, including product order transactions, downloading materials including product manuals and FAQs
  • Use any of our products, services, or applications in any manner
  • Participate in a research survey or testing and register your products with us

Who is responsible for your personal information?

Kitchen Accessories Limited (Company Registration Number 83226) trading as Gowan Home  is the Data Controller and is responsible for determining “why” and “how” your personal information is collected. Kitchen Accessories Limited is a limited liability company registered in Ireland.  To be able to deliver our services, we also determine which approved organisations we share your personal information with. All these organisations are bound by an obligation to implement appropriate security measures and have specific contractual terms on “how” and “when” they are allowed to use your personal information on our behalf. We only share the personal information the approved organisation needs to complete the particular task.

The manufacturer’s warranty on our products is provided by Sharkninja Europe Limited of 1st/2nd Floor Building 3150, Thorpe Park, Century Way, Leeds, England, LS15 8ZB. Sharkninja Europe Limited is a limited company registered in England. When you buy a product from us that was manufactured by Sharkninja Europe Limited we provide it with your name, address, contact information and confirmation of the product purchased by you.  This is so that Sharkninja Europe Limited is able to meet its obligations to you under the guarantee.  Sharkninja Europe Limited will be a Data Controller of the information we share with it. This means it can decide on “why” and “how” your data is processed. You can access full details of how Sharkninja Europe Limited deals with your information here.

As mentioned at Point 5 below occasionally other service providers we share your data with will also be data controllers for some or all of your data.

Some personal information could be considered sensitive, special, or protected. We do not routinely collect and use such information unless you choose to share it where no other option is available. We always comply with the applicable privacy legislation to collect, protect, and use your personal information safely (in particular, by seeking your consent where required).

If you interact with us on social media, what you post on Facebook, LinkedIn, Instagram, and X (as well as any other similar social media platforms) may sometimes include information that has been posted online and is publicly available. We aim to anonymise personal information collected through these platforms, but it is not always possible, and therefore we may collect your personal information. These online and social media sites are governed by the privacy notice of the data controller operating those sites or platforms, not by our Privacy Notice. You should carefully review those privacy policies before you use these sites to make sure that you are happy with how your personal information is being collected and shared.

We only collect information from third parties who have obtained your consent to share your information. This may include aggregated demographic information that provides insights into the relative affluence of households, from third-party data providers who help us to give you a more relevant experience by enabling us to provide offers, and to give you more relevant services and advice.

Our products and our websites are not designed for children under the age of sixteen (16) years old. If we become aware that we have collected personal information from children, we take every reasonable effort to delete or anonymise this information.

If we do unintentionally collect children’s personal information, we will delete it as soon as reasonably possible.

Sharing Your Personal Information

At Kitchen Accessories Limited trading as Gowan Home, we will never sell your personal information to any third party.

We share your personal information with carefully selected service providers who  provide services to you on our behalf, helping us fulfil our contractual obligations or assisting us in carrying out the purposes we process your personal data as described in this Privacy Notice. Generally, these service providers act as data processors of the data we share, and we stipulate how your data is to be used. On occasion the service provider will be a data controller of some or all of the data we share because it needs to be able to decide “why” and “how” the data is used – for example a delivery service provider will decide on the operation of its parcel tracking service. We have contracts in place with these providers that stipulate they comply with data protection law to include that they provide their service via secure methods. The service providers are only provided with the amount of your personal information necessary for their task, and no more.

Our Service Providers Include:

  • Logistics and Transport Providers: Delivers and collects products to and from your delivery/home address.
  • Customer Call Centre: Provides support to our customers regarding our products and services.
  • Payment Processing Providers: Process your order payment, including through secure services such as credit/debit card processors, Apple Pay, and Google Pay. These providers only receive the payment information necessary to complete your transaction.
  • Age Verification Service: Onlyage-Age Verifier app to verify your age before providing access to certain products restricted to users above a certain age e.g. for the purchase of knives and other age-restricted items.
  • IT Service Providers: Host and manage our systems, applications, and data storage including cloud computing.
  • Product Review Partner: Bazaarvoice — invites you to review your purchase on our behalf and displays verified product reviews on our website. Only limited order data (name, email address, and product details) is shared for this purpose.

We will share your personal information if required to do so by law enforcement authorities or regulatory bodies, with our legal counsel, or as necessary to protect our property, interests, and rights.

In the event of a sale of all or substantially all of our business or another similar transaction (such as a sale of a division or business unit), we may transfer or disclose your personal information to a purchaser or prospective purchaser, who may collect, use, and disclose such information for the purposes of evaluating and/or effecting a proposed transaction or operating and managing the affairs of the acquired business, or for other purposes identified in this Privacy Notice. The disclosure of your personal information in these circumstances would be subject to and dependent on the proposed purchaser signing a strict confidentiality agreement. Data minimisation principles require us to process only so much of your personal information as is strictly necessary. Anonymisation or pseudonymisation of your personal data will be applied, where possible.

How Long Do We Keep Your Personal Information?

We will only keep personal information for as long as is necessary for the purposes we have collected it, as described in this Notice, and as required by Irish law, such as

Marketing Communications (no account):

Where you do not have an account with us and have consented to receive our marketing communications, we will stop sending you marketing immediately once you opt out and will remove your personal information from our active marketing systems within 30 days. However, we will retain a minimal record of your consent and withdrawal (for example, your email address and the date of your opt-in/opt-out) for up to 2 years after withdrawal or inactivity, solely to demonstrate compliance with GDPR.

Cookie Consent Logs: Records of your cookie preferences and consent choices are retained for 12 months from the date of consent or until you withdraw or update your preferences, whichever occurs first. This allows us to demonstrate compliance with GDPR and ePrivacy requirements.

Inactive Accounts (no purchases):

Where you create an account with us but do not complete a purchase, we will retain your account information for up to 3 years of inactivity, after which it will be deleted unless you choose to re-activate your account. This ensures we do not retain personal data longer than necessary where no purchase has been made.

Product Purchases: We may keep your personal information for 7 years where you have purchased a product from us to facilitate your guarantee and our obligations under the applicable consumer regulations and otherwise in accordance with law.

Product Reviews (Bazaarvoice): Review invitation and moderation data processed by Bazaarvoice is retained for the duration of our contract with Bazaarvoice and deleted upon termination or deletion request. Limited backup copies may remain for up to 1 year, in line with Bazaarvoice’s retention policy.

Customer Service Interactions: Recordings of your interactions with our customer service will be kept for a maximum of 3 months. However, recordings may be kept longer if they may be required as evidence in an alleged dispute or legal claim.

Uploaded Photos of Faulty Goods: Photos submitted by customers to evidence product faults or damage will be retained for up to 2 years from the date the claim is closed, to allow for product quality reviews, warranty verification, and potential legal claims. After this period, images will be securely deleted or anonymised.

Downloaded Reports from Shopify: Operational reports downloaded from Shopify (including order, payment, and customer service data extracts) are retained for up to 7 years, consistent with our legal, accounting, and audit obligations. Reports are securely deleted once the retention period has expired.

Legal Challenges: We may keep your personal information until the time limit for any legal challenges to the supply of the goods or personal injury claims has expired

Legal, Tax, and Accounting Purposes: We may retain personal information for a longer time where we are obliged to do so in accordance with relevant legal, tax, and accounting purposes.

How do we protect your personal information?

We are strongly committed to keeping your personal information safe. We have adopted specific technical and organisational measures to protect your personal information against accidental or unlawful destruction, accidental loss, alteration, unauthorised disclosure or access, which comply with regulatory requirements in Ireland.

We limit access to your personal information to those who have a genuine need to know it. Those processing your information will do so only in a lawful manner and are subject to a duty of confidentiality.

Whilst we can take every precaution to protect your personal information, it is important that you keep your passwords, account details and other user information secure and confidential.

International Transfer of Personal Information

We may transfer your personal data outside of Ireland where it is lawful to do so and in accordance with this Privacy Notice. We will not transfer your personal data outside the European Economic Area (the “EEA”) unless it is to a country in which data protection rules have been deemed adequate by the European Commission, or we have a contract with the data recipient which includes Standard Contractual Clauses (SCCs) approved by the European Commission for transferring personal data outside the EEA, or it is otherwise lawful to do so in accordance with Article 45 of the General Data Protection Regulation.

Where limited personal data is shared with our service providers, including Shopify, Microsoft, Google, Meta, and Bazaarvoice — such transfers are protected by the providers’ EU-approved transfer mechanisms, including Standard Contractual Clauses, to ensure an equivalent level of protection for your personal data.

Under Irish law, you may exercise the following rights regarding your personal information:

  • Right to Access: You have the right to access personal information held about you and to request copies of your personal information.
  • Right to Rectification: You can request that we correct any inaccuracies in your personal information. Additionally, if you believe any information is incomplete, you have the right to ask for it to be completed.
  • Right to Erasure: You can ask for your personal information to be deleted in certain circumstances.
  • Right to Restriction of Processing: You have the right to request that we restrict the processing of your personal information in specific situations.
  • Right to Object: You can object to the processing of your personal information when it is based on our legitimate interests. If we are using your personal information for direct marketing, you can ask us to stop, and we will comply with your request.
  • Right to Object to Automated Decision-Making: You have the right to object to decisions made solely on automated processing, including profiling, which may produce legal effects concerning you or significantly affect you.

We will regularly review and update this Notice, so we encourage you to review it periodically. If we change our Privacy Notice in a way that significantly changes how we process the personal information we hold about you we will alert you to material changes by placing a notice on our websites, or by sending you an email (if you have registered your e-mail details with us).

Any significant changes in processing will come in to force no sooner than thirty (30) days after notification through this Notice unless otherwise required by Irish law.
